Welcome to LOUD 3D! By engaging in our services, you agree to the following terms and conditions:
Services Provided
- LOUD 3D provides a range of services, including but not limited to 3D modeling, conceptual design, architectural design, and project execution. Specific project details and deliverables will be outlined in the project estimate and contract.
Payment Terms
- A deposit is required before the commencement of any project unless otherwise agreed upon with the client in writing.
- The remaining balance is due upon project completion and before final deliverables are provided.
- All deposits are non-refundable.
Scope of Work and Revisions
- Each 3D modeling or design project includes up to two (2) revisions. Additional revisions requested by the client will incur additional charges.
- The scope of work will be agreed upon before project initiation. Any changes requested after the project has started may lead to additional charges and require a project timeline adjustment.
Intellectual Property and Usage Rights
- LOUD 3D retains ownership of all 3D models and designs created unless specifically transferred in writing to the client.
- Unless otherwise agreed, the client’s rights to use the 3D models and designs are limited to internal use only for their project. Commercial distribution, modification, or resale of our work by the client is not permitted without explicit written approval.
- LOUD 3D grants clients the right to sell the project itself (e.g., the building or real estate project) after completion without additional permission.
Confidentiality
- LOUD 3D respects client confidentiality. All project details and communications are private and will not be disclosed to third parties unless agreed upon with the client or as required by law.
Termination and Refunds
- Clients may choose to terminate the project at any time; however, any deposit paid is non-refundable.
- If the deposit is different from the standard 30%, the amount agreed upon will still be considered non-refundable.
Portfolio and Marketing Rights
- LOUD 3D reserves the right to use completed projects in its portfolio and for marketing purposes. Clients may opt out of this by sending a written request to info@loud3d.com.
- By default, LOUD 3D may feature project images, descriptions, and other media for marketing and promotional purposes, unless a formal request to withhold publication is received from the client.
Compliance with Code and Regulations
- LOUD 3D is not responsible for obtaining permits, approvals, or regulatory compliance for completed designs unless we are specifically hired to manage this process.
- It is the client’s responsibility to ensure all designs meet the relevant building codes and regulations in their jurisdiction.
Limitations of Liability
- LOUD 3D will not be held liable for any indirect, incidental, or consequential damages arising from the use of its designs or services.
- Our liability for direct damages shall not exceed the total fees paid by the client for the specific project at issue.
Amendments to Terms
- LOUD 3D reserves the right to amend these Terms and Conditions at any time. Clients will be notified via email if there are updates to the terms that may affect ongoing projects.
- Continued use of LOUD 3D services after such changes implies acceptance of the revised Terms and Conditions.
Additional Terms
- Communication: All official communications, including project amendments, portfolio requests, or other formal notices, should be directed to info@loud3d.com.
- Governing Law: These Terms and Conditions are governed by the laws of the jurisdiction in which LOUD 3D operates.
- Dispute Resolution: Any disputes that arise will be handled through mediation before escalating to legal action.
